Builderz WA Service Engagement Terms, Condition & Fee

By accessing this website or engaging with Builderz WA, you acknowledge and accept these risks and agree to be bound by these Terms and Conditions.

1. Nature of Services

Builderz WA provides advisory, coordination and facilitation services relating to property investment, feasibility assessment, co-living housing, construction coordination and related activities.

Builderz WA is not:

• A licensed builder (unless expressly stated otherwise in writing)
   
• A real estate agent
   
• A financial adviser
   
• A lender or credit provider
   

No fiduciary, partnership or agency relationship is created between you and Builderz WA unless expressly agreed in writing.

2. No Guarantee of Outcomes

All information provided by Builderz WA is based on assumptions, third-party information and market conditions at the time.

Builderz WA does not guarantee:

• Planning or development approval
   
• Construction timeframes or costs
   
• Availability of land or finance
   
• Rental income, yields or investment returns
   
• Market performance or tenant demand
   

Any projections, feasibility discussions or indicative figures are estimates only and must not be relied upon as guarantees.

3. Investor Responsibility

You acknowledge and agree that:

• All decisions are made at your own discretion and risk
   
• You are responsible for conducting your own due diligence
   
• You independently assess the suitability of any investment
   

You enter into contracts with builders, land sellers, lenders and other third parties directly and independently.

4. Third-Party Relationships

Builderz WA may introduce or coordinate engagement with third parties, including but not limited to:

• Builders and contractors
   
• Finance brokers and lenders
   
• Settlement agents and conveyancers
   
• Land sellers and developers
   
• Consultants, suppliers and service providers
   

Builderz WA:

• Does not control third parties
   
• Is not responsible for their acts, omissions or performance
   
• Is not a party to third-party contracts
   

All third-party engagements are at your own risk.

5. Disclosure of Fees, Commissions and Benefits

You acknowledge and agree that Builderz WA may receive fees, commissions, referral payments, incentives or other financial or non-financial benefits from third-party service providers we introduce or recommend.

These third parties may include, but are not limited to:

• Builders and contractors
   
• Finance brokers, lenders and financial service providers
   
• Settlement agents and conveyancers
   
• Land sellers, developers and real estate professionals
   
• Consultants, suppliers and service providers
   

Any such benefits may be received regardless of whether you proceed with a project or enter into contracts with those third parties.

You acknowledge that:

• These arrangements do not affect your obligation to conduct independent due diligence
   
• You are not required to use any recommended provider
   
• Builderz WA’s role is advisory and facilitative only
   

To the extent permitted by law, you waive any claim arising from the receipt of such fees, commissions or benefits by Builderz WA.

6. Fees, Deposits and No Refunds

All fees and deposits paid to Builderz WA are strictly non-refundable, including onboarding fees, advisory fees, coordination fees and deposits, regardless of project outcome.

Fees are payable once services commence and are not contingent on:

• Project approval
   
• Finance approval
   
• Land acquisition
   
• Construction proceeding
   

Failure to pay fees may result in suspension or termination of services.

7. Limitation of Liability

To the maximum extent permitted by law:

• All implied warranties, representations or conditions are excluded
   
• Builderz WA is not liable for indirect, consequential or economic loss
   
• Builderz WA’s total aggregate liability is limited to the fees paid to Builderz WA for the relevant services
   

Nothing in these Terms excludes liability that cannot be excluded under Australian law.

8. Indemnity

You agree to indemnify and hold harmless Builderz WA, its directors, managers, officers, employees, contractors and representatives from and against any claims, losses, damages, liabilities, costs or expenses arising from or in connection with:

• Your reliance on information provided by Builderz WA
   
• Any decision, action or omission by you
   
• Any contract or arrangement entered into between you and a third party
   
• Any breach of these Terms and Conditions
   

This indemnity survives termination of your engagement with Builderz WA.

9. Intellectual Property

All content, designs, plans, layouts, documentation, branding, images and materials are the intellectual property of Builderz WA or its licensors.

You must not copy, reproduce, distribute or use any material without prior written consent.

10. Confidentiality

All information shared during discussions, inductions, feasibility assessments or onboarding is confidential and must not be disclosed without written consent, except where required by law.

11. Privacy

Personal information is handled in accordance with our Privacy Policy. By engaging with us, you consent to the collection, use and disclosure of personal information as outlined in that policy.

12. Suspension and Termination

Builderz WA may suspend or terminate services at any time if:

• Fees are unpaid
   
• Information provided is false or misleading
   
• Continued engagement would expose Builderz WA to unreasonable risk
   

Termination does not affect accrued rights or obligations.

13. Force Majeure

Builderz WA is not liable for delay or failure caused by events beyond reasonable control, including changes in law, government actions, supply chain disruption, labour shortages, natural events or market conditions.

14. Website Use

You must not misuse the website, interfere with its operation, introduce malicious code or use it for unlawful purposes. Content may be modified or withdrawn without notice.

15. Governing Law

These Terms are governed by the laws of Western Australia. You submit to the exclusive jurisdiction of the courts of Western Australia.

16. Changes to Terms

Builderz WA may update these Terms at any time. Continued use of the website or services constitutes acceptance of the updated Terms.
